1. Eligibility & Account Responsibilities

• You must be 18 years or older and authorized to act on behalf of your business or organization.

• You agree to provide accurate, complete, and current information during registration.

• You are solely responsible for maintaining the confidentiality of your login credentials and all actions performed under your account.

• You must notify us immediately if you suspect unauthorized access.

2. Permitted Use of the Platform

OutdoorX allows you to:

• Control, automate, and monitor advertising hoardings

• Use smart switch technology for ON/OFF operations and scheduling

• Access live camera snapshots, meter readings, and device status

You agree NOT to:

• Reverse engineer, modify, or tamper with the app, devices, or APIs

• Bypass security features or misuse the platform

• Scrape, copy, or resell any part of the system

• Use the platform for any unlawful or unauthorized purpose

3. Devices, Installation & Operational Responsibility

• Devices installed at your site or hoarding location become your responsibility to maintain and protect.

• You must ensure that only authorized personnel operate the devices.

• We are not liable for damage or failure caused by:

  • Tampering

  • Physical damage

  • Electricity fluctuations

  • Wrong wiring or installation by third parties

  • Unauthorized modifications

4. Smart Timer, Scheduling & Control

• You are fully responsible for configuring schedules (ON/OFF timings).

• Operational output depends on correct setup done by the client.

• Live camera and meter readings are for monitoring only and do not replace physical inspection.

• OutdoorX is not liable for losses resulting from incorrect scheduling, configuration errors, or misuse.

5. Billing, Payments & Refunds

• Services are billed as per your selected plan, contract, or usage.

• Monthly/periodic invoices include applicable GST.

• Late payments may result in temporary suspension of services.

• All payments are final and non-refundable unless explicitly agreed in writing.

• No credit is provided for downtime caused by power failure, network issues, or external factors beyond our control.

6. Support, Warranty & Maintenance

• Remote support, diagnostics, and firmware updates are provided during the active service period.

• Physical servicing, site visits, or device replacements outside warranty will incur additional charges.

• Scheduled maintenance may cause temporary downtime, which will be communicated in advance whenever possible.

• Warranty does not cover electrical surges, environmental damage, or unauthorized modifications.

7. Data Privacy & Security

• We collect only the data required to operate and improve the service (refer to our Privacy Policy).

• Data is stored securely and shared only when required by law or essential third-party partners (SMS, cloud, payments).

• You agree to our Privacy Policy, available on our website/app.

8. Suspension & Termination

We may suspend or terminate your account if:

• You violate these Terms

• Illegal or harmful activity is detected

• Payments remain overdue

• Devices are misused or tampered with

Either party may terminate the service with 15 days’ written notice.
Upon termination, access to the platform and devices may be restricted.

9. Limitation of Liability

• Continuous uptime is not guaranteed.

• We are not responsible for losses caused by:

  • Network outages

  • Power failures

  • Device misuse or incorrect installation

  • Third-party service disruptions

  • Natural disasters or force majeure events

Our total liability is limited to the amount paid by you in the last three (3) months preceding the claim.

10. Intellectual Property

• All software, dashboards, firmware, designs, branding, and content belong to Times Media / OutdoorX.

• You are granted a limited license to use the platform for business operations only.

• Unauthorized copying, redistribution, or modification is strictly prohibited.

11. Amendments to Terms

We may update these Terms periodically.
If major changes are made, you will be notified by email or app alerts.
Continued use of OutdoorX after updates constitutes acceptance of the revised Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India.
All disputes will fall under the jurisdiction of the courts of Ahmedabad, Gujarat.
